Inter-Tertiary Moot – Representing USP in Fiji

The Inter-Tertiary Moot is a mooting competition held within Fiji, bringing together law students from multiple tertiary institutions across the country. Teams from USP, Fiji National University (FNU), and other Fijian institutions compete before a panel of judges comprising legal practitioners, academics, and occasionally members of the judiciary.

Each team prepares written submissions and delivers oral arguments on a challenging legal problem.

Why participate?

The winner of the USPLSA Internal Moot earns the right to represent USP at the Inter-Tertiary Moot in Fiji.

USPLSA Internal Moot – Your Pathway to Advocacy

The USPLSA Internal Moot is the flagship mooting competition within USP's School of Law, organized by the USP Law Students Association. Open to all enrolled law students, it serves as both a training ground for novice mooters and the official selection pathway for students wishing to represent USP at the Inter-Tertiary Moot in Fiji.

Participants are paired into teams and assigned a legal problem. Each team prepares written memorials and presents oral submissions before a panel of judges comprising senior law students, tutors, and legal practitioners.

What you will gain:

The USPLSA Internal Moot is held in Semester 2. Registration opens at the start of the semester. No prior mooting experience is required.

Constitution Highlights:

  • Article 1 – Establishment: Establishes the USPLSA - Laucala within the University of the South Pacific.
  • Article 2 – Vision, Mission & Objectives: Sets out the association's vision, mission (e.g., advocate for students, empower future legal leaders), and core objectives.
  • Article 3 – Membership: Defines who qualifies as a member (LLB students or those enrolled in at least one law unit at Laucala Campus).
  • Article 4 – Powers of the Executive Committee: Lists the executive's powers, including organizing activities, approving budgets, and forming affiliations.
  • Article 5 – Appointment of Subcommittees: Provides for the creation, composition, duties, and reporting requirements of subcommittees.
  • Article 6 – Executives: Specifies the executive structure (President, 2 Vice Presidents, 8 committee members, patron), and rules for bank signatories.
  • Article 7 – The Leadership Code: Outlines ethical obligations for executives (e.g., commitment to the association, impartiality, accountability).
  • Article 8 – General Duties of Executives: Prohibits behavior that demeans the office or association or damages integrity.
  • Article 9 – Conflicts of Interest and Disqualification: Requires disclosure of conflicts and prohibits misuse of association property or information.
  • Article 10 – Tenure of Office, Resignation and Termination: Covers how office becomes vacant (death, resignation, removal, loss of student status), resignation process, attendance rules, and removal procedure (2/3 majority vote). Also limits consecutive terms to two.
  • Article 11 – Office of the President: Defines the President's role as executive head and chair of meetings.
  • Article 12 – Office of the Vice Presidents: Describes the two Vice Presidents' duties and the process for acting President during absences.
  • Article 13 – Treasurer: Sets out financial responsibilities (accounts, reports, cheque signing) and qualification requirements (accounting background).
  • Article 14 – Secretary: Lists administrative duties (minutes, records, correspondence, election duties, liaison with public relations).
  • Article 15 – Elections: Details the annual election process: timing (11th week of semester 2), nomination requirements (including transcript with GPA β‰₯2.5), voting, tie-breaking, oath-taking, and handover procedures.
  • Article 16 – Vacancy: Explains how to fill a vacant executive position via secret ballot of the remaining executive committee.
  • Article 17 – Annual General Meeting (AGM): Defines the AGM as the highest authority – timing, notice, quorum (50 members), chairing, annual reports, and amendment powers.
  • Article 18 – Special General Meeting (SGM): Specifies grounds for calling an SGM (President's instruction, executive decision, or member request), quorum, chairing rules, and vote of no confidence procedures.
  • Article 19 – Resignation: Reiterates the 14-day written notice rule and automatic removal for missing three executive meetings without notice.
  • Article 20 – Disciplinary Powers: States that serious disciplinary matters are referred to the USPSA (parent body).
  • Article 21 – Compliance with the USPSA Constitution and By-Laws: Affirms USPSA as the governing body; association must comply, report, and allow audits.
  • Article 22 – Amendments to the Constitution: Sets out the amendment process (AGM or SGM, 2/3 majority, USPSA approval, review every 3 years from 2024).
